Where liability cannot be excluded, any liability incurred by use in relation to participation in the Program is limited to the extent provided by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). To the extent permitted by law, we will not be liable for any indirect, special or consequential loss.
You agree that Parkinson’s Empowered is not responsible to you or others for any loss or damages that results from your use (or non-use) of this website or any linked third-party website. Your sole and exclusive remedy against Parkinson’s Empowered is to stop using this website.

Parkinson’s Empowered is not responsible for the operation, security, or availability of any third-party platform, although reasonable efforts are made to select reputable providers.
9. Submissions of information.
Do not send Parkinson’s Empowered any unsolicited ideas, suggestions, materials, concepts, or other information (collectively “Information”) relating to the website. If you violate this policy and do send Information to Parkinson’s Empowered, that Information will become Parkinson’s Empowered’s property. This means that Parkinson’s Empowered will have unrestricted use of it for its personal and commercial purposes. You will not be compensated, and Parkinson’s Empowered will not be liable to you or any other provider of the Information.
If you send Information to Parkinson’s Empowered, you agree:

You agree that Parkinson’s Empowered is not responsible for any injuries that you sustain from participation in any of the activities depicted on the on the website or through the Content or the Service. You expressly waive any claim for any injury at any time against Parkinson’s Empowered, or any person or entity involved with Parkinson’s Empowered, including, without limitation, its directors, principals, instructors, independent contractors, employees, agents, contractors, affiliates, and representatives.
Your use of the website, the Content, and/or the Service evidences your understanding that physical exertion may result in physical or mental injury or risk of injury. You further agree that you are solely responsible to exercise within your limits.
You should SEEK THE ADVICE OF A DOCTOR PRIOR TO BEGINNING A PHYSICAL EXERCISE REGIMEN. IF YOU FEEL FAINT, DIZZY, OR HAVE PHYSCIAL DISCOMFORT, STOP IMMEDIEATELY, AND CONTACT YOUR DOCTOR.
Parkinson’s Empowered may suggest a particular technique, use of equipment, pose, move, or instruction, but it is your sole responsibilities to ascertain if such technique, use of equipment, pose, move, or instruction is consistent with your ability and safe for you to do.
15. Payments.
The current prices for Move to Thrive, 1:1 Coaching, and the Parkinson’s Empowered membership are listed on the relevant program or service pages at the time of purchase. Parkinson’s Empowered reserves the right to change pricing at any time. Any change will not affect purchases already completed.
Payment for all programs and services is required in full at the time of purchase unless expressly stated otherwise.
All payments are processed in Australian Dollars (AUD) unless otherwise specified.
Parkinson’s Empowered uses secure third-party payment processors. By providing your payment details, you authorise Parkinson’s Empowered (and its third-party providers) to charge the full amount to your chosen payment method.
Any promotional pricing, discounts, or trial offers are limited and subject to the specific conditions displayed at the time of purchase.
16. Cancellations and Refunds.
Nothing in this policy excludes or limits your rights under the Australian Consumer Law. You are entitled to a refund, replacement, or remedy if the services fail to meet a statutory guarantee.
MOVE TO THRIVE
Refunds for Move to Thrive are available only within a limited window due to the nature of the program materials and intellectual property shared.
You may request a refund if you notify Parkinson’s Empowered after receiving access to Week 1 of the program and before Week 2 content becomes available in the Parkinson’s Empowered App.
Refund requests made outside of this window will not be eligible, except as required under the Australian Consumer Law.
Where a refund is approved, it will be processed within 14 business days.
Refund requests must be submitted in writing to hello@livewellpd.com.
1:1 COACHING
Sessions must be booked in advance at mutually agreed times.
You may reschedule a session by providing at least 24 hours’ notice. Sessions cancelled or re-scheduled with less than 24 hours’ notice will be forfeited without refund.
All purchased sessions must be used within 12 months of purchase. Expired sessions will be forfeited.
Refunds are not available for completed, expired, or unused sessions.
If Parkinson’s Empowered is unable to deliver a service as agreed, you will be entitled to a refund or credit in accordance with the Australian Consumer Law. Refunds required under the Australian Consumer Law will be processed within 14 business days.
Refunds are not provided if you choose to discontinue or change your mind, except as required under the Australian Consumer Law.

PARKINSON’S EMPOWERED MEMBERSHIP
Memberships are billed on a recurring monthly, quarterly or annual basis (as selected at sign-up)
Monthly Memberships: You may cancel at any time. Your access will remain active until the end of your current billing period, and no further payments will be taken.
Quarterly Memberships: You may cancel at any time. Your access will remain active until the end of the three-month period you have paid for, and the membership will not auto-renew.
Annual Memberships: You may cancel at any time, however, refunds are not available once payment has been made. You will retain access to all membership content and services until the end of your 12-month term.
Refund requests must be submitted in writing to hello@livewellpd.com.
17. No guarantee of outcome.
Parkinson’s Empowered has made efforts to provide accurate information on the website, the Content, and in the Service. But any testimonial or example on the website or in the Content or the Service does not guarantee that you will receive similar results. Your results will depend on your background, effort, overall health, motivation, desire, and many other factors that are beyond the scope of the website, the Content, or the Service.
Parkinson’s Empowered makes no guarantee and no warranty that you will have any specific result.
18. Intellectual property infringement.
Parkinson’s Empowered respects intellectual property rights. If you think that material that appears on our website is subject to copyright or trademark infringement, please provide us with following information: (1) The claimed infringement; (2) reasonably sufficient information to allow Parkinson’s Empowered to locate the claimed infringement on the website; (3) the owner or complaining parties contact information, including name, address, and email address; (4) the signature of the owner; (5) a statement by the owner that the owner has a good faith belief that the use of the copyright or trademark is not authorized by the copyright or trademark owner, its agent, or the law; (6) a statement, under penalty of perjury, that the information is accurate, and you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
19. No assignment.
The conditions of use and licenses may not be transferred or assigned by you but may be assigned by us without restriction.

By providing Parkinson’s Empowered with your email address, you consent to receive unencrypted and unsecured email communications form us. You agree that any notices, agreements, disclosures or other communications that Parkinson’s Empowered provides to you by email satisfies any legal communication requirements.
21. Amendments and modifications.
Parkinson’s Empowered may amend or update the privacy policies, these conditions of use, the Content or the Service at any time without prior notice. If you use this website after any changes, you agree to be bound by the changes.
22. Affiliate disclaimer.
Parkinson’s Empowered may receive payment if you purchase products or services through such links.
Parkinson’s Empowered only utilizes affiliated links for products or services that its principals have personally used and believes will add value to its visitors.
23. Governing Law and Jurisdiction.
By accessing and using this website, you agree that these Terms and Conditions are governed by the laws of Western Australia, Australia, and you submit to the exclusive jurisdiction of the courts of Western Australia.
